Terms and Conditions of participation and data usage for the Competition "Celebrate the Reformation"

The participation in the Competition “Celebrate the Reformation” requires Participants to act in good faith, in full compliance with the following Rules and respectful of the rights of other Participants.

1.    Operator of the Competition

Operator of the Competition is TourComm Germany GmbH & Co. KG, Olbrichtstraße 21, 69469 Weinheim, Germany on behalf of the Thuringia Tourist Board and Investment and Marketing Corporation Saxony-Anhalt, Germany.

2.    Purpose of the Competition:

The Purpose of the Competition is the draw of

  • 100 Books about Martin Luther for the first 100 participants  each
  • 100 “Little Luther” Playmobil figure for the second 100 participants
  • 1 Statue of Martin Luther for the year´s photograph uploaded on the website www.visit-luther.com/celebrate-the-reformation/upload/

All submitted and uploaded photographs take part in the Competition and will be publicly displayed on the website www.visit-luther.com /www.celebrate-the-reformation.com and used on any of the website´s social media channels  e.g . Facebook, Pinterest, Instagram, Youtube.

3.    Participants

Entry is open to every individual person who successfully uploaded a photograph and chosen to join the Competition. Each participant shall enter the Competition only up to a maximum of 5 photographs.

4.    The Competition

The Competition starts now until October 31, 2017. Within this period of time participants are invited to take a photograph of their church, choir or church community and upload it on our website “www.visit-luther.com/celebrate-the-reformation/upload/”.

The first 100 participants receive the prizes “Book about Martin Luther” and the second 100 participants receive a “Little Luther” Playmobile figure. Among all participants the year´s photograph will be drawn by random draw. The winner receives a Statue of Martin Luther. Determining of the winners shall be made at November 1st 2017. All winners will be notified via the submitted email address (used for uploading) and will have 7 days from the date they are notified to redeem the prize. Failure to respond within 7 days of notification will result in the disqualification of the winner. The prize will then be returned to inventory and the drawing will be continued. The winners will be also notified by e-mail of the procedure for claiming their prize.

Cash reimbursements of the prizes or a substitution of the prizes are not possible under any circumstances.

The operator reserves the right to alter or cancel the Competition at any time without prior notice and without giving reasons in event of technical or legal problems that a proper performance of the Competition can no longer be guaranteed.

5.     Data Privacy

The data provided by participant in the form “upload your image” during uploading the photograph will be collected, stored and used exclusively for the duration of the Competition, organising and processing of the Competition until its conclusion. The data is not shared with third parties.

Participants of the Competition may claim their right to information about their data and correction or deletion of their data against the operator.

6.    Ownership of Rights regarding submitted and uploaded Photographs

Photographs submitted by the participant must has been created by himself as a photographer or by a person who has transferred him their rights in the photograph (photographers' rights).

Photographs submitted by the participant may not be used without the respective consent/license of the rights owner when protected under copyrights, intellectual property rights or other third party rights. The operator reserves the right to exclude photographs that violate third party rights at its own discretion

By participating in the Competition, the participant guarantees that the submitted photograph/s does/do not violate the rights of third parties. He assures that he has obtained all consents, licenses and rights required to submit the photograph/s lawfully to the Competition. The participant acknowledges and accepts that the operator is not obliged to use the submitted photograph/s and that the operator may refrain from using the photograph/s at his own discretion. The operator is indemnified and held harmless from all claims, indemnities, compensations, costs and responsibilities (including the costs of prosecution) by the participant, which may result from a breach of third party rights in respect the submitted photograph/s.

7.    Granting of Rights and Liability

The participant hereby agrees that his submitted and uploaded photograph/s to the Competition as well as his name in connection with the Competition, its drawing, handling and presentation of the participant´s submitted contribution/s will be publicly displayed on the website www.visit-luther.com /www.celebrate-the-reformation.com and used on any of the website´s social media channels   e.g. Facebook, Pinterest, Instagram, Youtube.

The granting of the above mentioned rights is intended solely for the operation and the provision of the Competition "Celebrate the Reformation" and the presentation of participant contributions in connection with this Competition as part of the celebrations of the 500th anniversary of the Reformation.

To the fullest extent permitted by law, the operator of the Competition can accept no responsibility for any accident, loss or damage to prize winners or their property as a result of accepting the prize.

The operator is liable for damages only if the damage is due to intent or gross negligence. The operator is liable for the culpable injury to a natural person's life, limb or health, even if he is merely negligent. In addition, the operator is also liable for only negligent violation of a cardinal obligation. Cardinal obligations are those whose fulfilment only enables the proper performance of the Competition, and whose fulfilment participants could reasonably rely on. The above limitation of liability applies, in particular, to damages caused by errors, delays or interruptions in the transmission of data, in the case of technical equipment or service faults, incorrect contents, loss or deletion of data, viruses or otherwise in the use of the website.

The operator is not liable for breaches of third-party rights by uploads of the participants and does not guarantee that uploads submitted do not contravene any third-party rights.

8.    Miscellaneous

These conditions are subject to the law of the Federal Republic of Germany, with the exclusion of international private law and the UN purchase law. If any part of these conditions are determined to be invalid or unenforceable pursuant to applicable law then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.
